Detached not in local code yet
Kaysville currently allows internal accessory dwellings only. The city’s published guidance says a detached structure — including an apartment over a garage — cannot be used as a dwelling. Senate Bill 284 changes that picture on qualifying lots beginning October 1, 2026.
- Internal ADU
- Permitted on lots of 6,000 sf or larger. Owner occupancy required. Long-term occupancy only (30 days or more).
- Detached ADU
- Not allowed under current Kaysville code. From October 1, 2026, a detached ADU must be a permitted use on lots of 11,000 sf or larger that already have a house. Confirm with planning whether the implementing ordinance is in place.
- Lot
- Internal: typically 6,000 sf or larger. Detached (from Oct 1, 2026): 11,000 sf or larger with a single-family house.
- Size
- Internal units have no state size cap. A future detached unit cannot exceed the primary dwelling.
- Parking
- One dedicated paved stall for the IADU, plus a two-car garage and a two-car driveway — among the stricter parking rules in the county.
- Owner occupancy
- The owner must occupy the IADU or the primary dwelling as their primary residence.
- Rental
- Long-term only (30 days or more).
- Design
- The house must keep its single-family appearance. Additions and remodels to create an IADU need a building permit.
